Terms and Conditions

GoApp Comércio Online de Produtos e Serviços para Animais de Estimação LTDA (“Owner”)., sole and exclusive holder of the rights relating to the https://woof.pet website, the Woof application and the intellectual property associated therewith (including but not limited to the trademark Woof), sets forth these “Terms and Conditions” (“Terms and Conditions”), with the goal of allowing users, whether or not registered at the Platform (as defined below) (“User”) to use the application, site, social networks, as well as any other form of media, whether available on the Internet or not, owned by Owner (“Platform”).

These Terms and Conditions are organized in three sections:

• Declaration of Rights and Responsibilities, where you can find a description of your relationship with the Owner and other Users, as Users of the Platform, including our Community standards;
• Security, Privacy and Intellectual Property, where we describe our use of your data as a User and provide further detail on the protection of your privacy and the intellectual property relating to the Platform;
• Other, where we tell you everything else you need to know about the Platform.

Declaration of Rights and Obligations

We love animals. All animals. The purpose of the Platform is to reflect in the digital dimension the resources for your pet available in your region. In this way, we are creating an ecosystem of pets and fulfilling a fundamental part of our mission, which is to help our Users to provide a better quality of life for their pets. In order to achieve our objectives that have driven us to develop the Platform we have prepared as part of these Terms and Conditions this Declaration of Rights and Responsibilities (“DDR”). This DDR sets forth the terms of service that govern your relationship, as a User, with other Users, the Owner, the establishments and/or business registered in the Platform, as well as your interactions with the brands, products, and services offered at the Platform. In the case that such brands, products, and services have separate terms of use, and these terms are in conflict with these Terms and Conditions, the terms of use associated with such brands, products and service shall prevail with respect to the use of their respective brands, products and services in relation to these Terms and Conditions specifically regarding the point in conflict.

By navigating, downloading any content or using the Platform and as a condition for your visit, download or use, as the case may be, you fully agree with the provisions set forth in these Terms and Conditions. The purpose of these Terms and Conditions is to describe your rights and obligations as a User and to preserve the safe use by you of the Platform. Our goal is to preserve the best interest of the establishments and/or business registered at the Platform and of the Community as a whole.

Principles and Objectives

The Platform is a pet-centric platform. This means that your entire experience as a User is based on your pet’s data that you voluntarily share with us precisely so that we can give you a more assertive experience, according to your pet profile. Specifically, we have created the Platform aiming at improving pets’ quality of life and helping other pet owners with busy lives like ourselves to take better care of their pets.

The Platform is an online community that allows Users to:

• Register pet-related activities;
• Shop for pet products;
• Shop for pet services; and
• Search for pet related places.

Features

The Platform consists of two parts: Maps and Shop.

Maps (Community)

The objective of the Maps, that we also call Community, is allow pet owners to find everything that their pet needs in their region.

At our Community you can:

• Find pet related business;
• Review pet related business; and
• Book pet related services.

At our Community, Users can view and search pet related establishments and/or business in three ways:

• Typing what they are looking for on the top of Maps;
• Browsing through Maps; and
• Looking up the pet related business’ list in a specific region.

Maps require that Users share their location or choose a specific location to show the pet related business in the selected region.

The Owner reserves the right to restrict Users’ access to certain features of the Go Platform and, as the case may be, restrict Users’ access to the Platform and exclude Users if it identifies behavior that is not in accordance with these Terms and Conditions.

By taking the following actions, the User agrees to observe the principles of the Community described in these Terms and Conditions.

We do our best to keep the Platform safe. We need your help to keep the Platform safe and the experience fun. Please report any violations to these Terms and Conditions to us.

By using the Platform, you also agree to assist the Community as follows:

• Not to send unauthorized commercial communication (such as spam);
• Not to collect content or information from other Users, as well as not to access the Platform, using automated means (such as bots, robots, spiders or scrapers) without prior authorization;
• Not to take part in illegal multi level marketing, such as pyramid schemes, on the Platform;
• Not to upload viruses or other malicious codes;
• Not to request login information of, nor access an account belonging to another User;
• Not to intimidate, harass or bully any User;
• Not to transmit offensive content, containing hate speech, threatening or obscene content; incite violence; or which contain nudity or gratuitous or graphic violence;
• Not to use the Platform to engage in any illegal, malicious or discriminatory act;
• Not to do anything which disables, overburdens or obstructs the appropriate functioning or appearance of the Platform, such as a service denial attack or and interference in page processing or of any other Platform functionality; and
• Not to facilitate or foster a violation of these Terms and Conditions.

The services available on the Platform are offered and provided directly by the business indicated on the Maps. The Owner has no responsibility for the services offered on Maps and provided directly by the indicated business and reserves the right to exclude any business from its database. Shop

The Shop allows Users to shop pet products in a particular location. To improve your navigation, the Platform uses your registered pets’ data to personalize your experience and display to you products that are best tailored to your pets’ needs. 

Similarly, the Shop needs Users to either share their current location or to include their preferred location to show pet related products in their region. 

Based on your chosen location, the Shop allows Users to shop pet products in that region. Under no circumstance the Owner shares any personal information, including location, with others. SAFETY, PRIVACY POLICY AND INTELLECTUAL PROPERTY

Privacy

To allow the proper functioning of the Platform tools, we need you to provide some information and data, as well as authorize the use of some of your own information (eg location, access to the camera, access to the calendar, name, age, etc.).  Users are only able to see products, services and pets at their preferred location if we receive that input. We do not disclose your preferred location to anyone. Our use of your personal information and data is strictly related to the enhancement of your Platform experience. All the data transmitted from your computer or mobile device to our servers are encrypted. Please check our Privacy Policy for additional information.

Safety

The Owner wants you to use – and return – to the Platform. Ensuring a safe, trustworthy and fun experience is the basis of our development.

We have adopted the best standards and firewalls available on the market and we follow all applicable national and international safety standards. Your information is protected by standard SSL (Geotrust) security protocol. The Platform is certified by a company that specializes in information security and protection.

As with other online channels, once you post information on the Platform, that information becomes public. The Platform has Users located in several countries and who identify themselves to use the Platform. Only make publicly available information that you are comfortable with and in accordance with the guidelines of the Community. The Owner has no responsibility whatsoever for any content uploaded or posted by Users. We therefore ask you to be aware of the content you share on the Platform or from the Platform and let us know if you notice any activity that violates the Community standards of conduct.

Intellectual Property

The Owner retains all rights relating to the intellectual property (including but not limited to layouts, contents, animations, executions, applications, drawings, gifs, images, videos and banners) published by us (“Intellectual Property”) at the Platform. The Intellectual Property may not be reproduced without prior approval except via the Platform or the Owner’’s social networks.

In the Platform, you are responsible for the content you post. The Owner has no influence on any content arising from Users. The User declares that he / she owns all information and content that he or she sends to other Users through the Platform.

For content protected by intellectual property laws, such as photos and videos, when transmitting any content to any other User, you grant us a non-exclusive, transferable, sub-licensable, royalty-free, global license to use such content transmitted by you. This license expires when you delete your account, except when your content has already been shared with other Users and has not been excluded from the Platform.

Users agree that any content they have served on the Platform may be used by the Owner or Users for publishing or sharing purposes in any and all media or for data collection in order to enhance the Platform experience and the content to which you have access to.

OTHER

Registration and Account Safety

You agree to furnish truthful information when registering with the Go Platform.

We understand that the commitment by all Users concerning the following acts is fundamental to safeguard your Platform account:

• Not to furnish any false personal information on the Platform, nor to create an account for a person other than you without authorization. Not to create more than one personal account.
• Do not create more than one personal account.
• If we deactivate your account, not to create another one without our permission.
• Not to use the Platform if you are under 14 years old and, if you are a minor, and, if you are older than 14, but younger than 18, years old, not to use the Platform without your legal guardian’s supervision.
• Not to use the Platform if you have been convicted, judicially or administratively, for animal abuse.
• To keep your registered information correct and up to date.
• Not to share your password (or, if you are a developer, your secret code), to let another person access your account or to act in any way which may compromise your account’s safety.
• Not to transfer your account without a written permission from us.
• If you select a similar username or identification, we reserve the right to remove or recover such name or identification if we see fit (for example, when the owner of a commercial brand reclaims a username which has no relation whatsoever to the user’s real name).

Mobile phones and other mobile devices

We provide our services in the Platform free of charge. However, please keep in mind that the use of the Platform entails the use of data from your data package which you might have contracted with your Internet or mobile phone service provider. 

Amendments

• We will notify you before we make any amendments to these Terms and Conditions and you can consult the revised terms before continuing to use the Platform.
• If we make changes to policies, guidelines or other terms mentioned or incorporated in these Terms and Conditions, we may submit a notice on our site.
• If you continue to use the Platform after such change expressed by notice to our Terms and Conditions, this will constitute your acceptance of the terms, policies or guidelines changed.

Termination

If you violate the text or the essence of our Terms and Conditions, or generate a possible risk or legal exposure to the Owner, we may no longer provide certain features from the Platform. Depending on the circumstances, we may restrict your access to the Platform, including through the exclusion of your account. We will notify you by email about any action in this regard. You can also delete your account or disable your application at any time, safeguarding all our rights.

No Warranties

WE TRY TO MAINTAIN AN OPERATIONAL, SAFE AND ERROR-FREE PLATFORM, BUT YOU USE IT AT YOUR OWN RISK. WE PROVIDE THE PLATFORM, AS IT IS, WITHOUT EXPRESS OR IMPLIED WARRANTIES, INCLUDING, WITHOUT LIMITATION, IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE PLATFORM WILL ALWAYS BE SAFE, PROTECTED, ERROR-FREE, OR THAT THE PLATFORM WILL ALWAYS WORK WITHOUT INTERRUPTIONS, DELAYS, OR IMPERFECTIONS. THE OWNER IS NOT RESPONSIBLE FOR ANY THIRD PARTY ACTIONS, CONTENT, INFORMATION OR DATA, AND YOU EXEMPT THE OWNER, OUR OFFICERS, AND AGENTS OF ANY CLAIM OR DAMAGES, KNOWN AND UNKNOWN, ARISING OUT OF OR IN ANY WAY RELATED TO ANY CLAIM THAT YOU HAVE AGAINST THIRD PARTIES. WE ARE NOT TO BE LIABLE FOR ANY LOSS OF PROFITS OR OTHER CONSEQUENTIAL, SPECIAL, INDIRECT, OR INCIDENTAL DAMAGES ARISING OUT OF OR IN ANY WAY RELATING TO THE PLATFORM. IN ANY CASE, VALUE SHALL NOT BE SUPERIOR TO THE CORRESPONDING VALUE OF IMPORTANCE OF R$100 (100 REAIS). IN THE CASE THAT THE APPLICABLE LEGISLATION DOES NOT ALLOW FOR NEITHER A LIMITATION OR EXEMPTION OF RESPONSIBILITY FOR DAMAGES OF ANY NATURE, INCLUDING OF ACCIDENTAL OR CONSEQUENTIAL NATURE, THE RESPONSIBILITY OF THE OWNER WILL BE LIMITED TO THE MAXIMUM LIMIT PERMITTED BY THE APPLICABLE LEGISLATION.
